1. Do you need to order a certified copy at the same time or does the fee include a certified copy?

A certified copy cannot be ordered at the same time. Certified copies are processed through a different office and must be requested first.

It cost $3 per document for normal processing.

No. Mailed requests are usually processed within one business day.

4. What are my payment options?

5. How long does it take to get an Apostille certification from the State of Georgia?

Normal processing takes 1 business day, plus additional time for mailing.

6. How will the Apostille Certificate from Georgia come back after I order from the Georgia Superior Court Clerks' Cooperative Authority?

It will be returned by the type of return envelope you provide (i.e. a pre-addressed prepaid envelope or airbill). Return service by fax or email is not available.

1. What is the cost of filing a civil case?

The filing fee for all civil actions is $215.00 for the first plaintiff and defendant. Each additional party is $8.00. Divorce cases are filed for $220.00 and there is also a Sheriff’s service fee of $50.00 per service.

You can get a copy of your divorce records at the Closed File Room on the first floor of Fulton County Superior Court, 136 Pryor Street.

8. Can I get records notarized by your office?

The Clerk of Superior Court Office does not provide notary services. You can get
various documents notarized by the Magistrate Court (suite TG300 in the Justice Center Tower) or the Family Law Information Center (located on the 7th floor of the Justice Center Tower). The Justice Center Tower is located at 185 Central Avenue.

How to request a Writ of Fieri Facias (FiFa) for a Superior Court case?

For eFiled cases:

• Submit a notarized affidavit for issuance of Fifa through eFileGa.  The affidavit should reiterate the judgment amount and state whether any amount has been paid toward the judgment or not. 
• Mail-in a copy of the filed in office affidavit and a self-addressed stamped envelope, along with the $25 recording fee made payable to the Clerk of Superior Court

For manually filed cases:

• Mail-in a notarized affidavit for issuance of FIFA with an original signature.  The affidavit should reiterate the judgment amount and state whether any amount has been paid toward the judgment or not. 
• Mail-in the $25 recording fee made payable to the Clerk of Superior Court, along with a self-addressed stamped envelope.

1. What is a Notary Public?

A notary public is a person of demonstrated integrity appointed by a Clerk of Superior Court to serve the public as an impartial witness in taking acknowledgments, administering oaths and affirmations, and performing other acts authorized by law. Notaries are required to follow specific guidelines and exercise common sense judgement and discretion when executing their office.

2. Who is eligible to become a Notary Public?

In order to be appointed as a Notary Public in Fulton County, one must: •Be a resident of Georgia •Be a resident of Fulton County •Be at least 18 years of age •Be capable of reading and writing the English language

3. How do you apply to become a Fulton County Notary Public?

You must first complete an online application for Notary Public Commission. The application is located online at www.gsccca.org. All applications must be completed electronically. There are no paper applications. Fill out the form completely- including any criminal convictions (with the exception of minor traffic offenses) you have had.  All notary applicants (new and renewal) must submit a Sheriff’s office issued criminal background check with their application.

    *Exemption for attorneys only - Must present a current Georgia Bar card.

In addition, all new notary applicants must complete the online notary training and complete the online exam available at https://elearn.gsccca.org. There is a $10 fee associated with completion of the class and final exam. Applicants must achieve a score of 90% or higher.  This certificate shall be presented with your completed application.
     *Exemption for attorneys only - Must present a current Georgia Bar card.

Do Not sign application. Application must be signed in front of clerk’s office employee. Have two other residents of Fulton County who are not related to you, have known you for at least one month and are at least 18 years of age to fill out the endorsement sections of the applications attesting to your good moral character. Present the notary public commission application in person at any Fulton County Clerk of Superior Court’s office along with verification of your Fulton County residency such as a driver’s license or a valid Fulton County voter registration card. The fee is $51.00. Forms of payment accepted: cash, check, money order or debit or credit card.

4. How long is my Notary Public Commission good for?

A notary commission in the State of Georgia is four (4) years.

5. How can I renew my Fulton County Notary Public Commission?

You can renew your notary commission a minimum of 30 days before your commission expiration date by logging on to the GSCCA website at www.gsccca.org and completing the online renewal application. You may then present your application along with your notary training certificate of completion and a certified background check (issued by an area law enforcement office -no more than 30 days old) in person at any Fulton County Clerk of Superior and Magistrate Court’s Office or mail it to 136 Pryor St. SW Atlanta, GA 30303 ATTN: Notary Division. The cost to apply in person is $51.00. Renewals by mail are $56.00. NOTE: It is imperative to renew your commission prior to your expiration date. Once your commission has expired, you will need to apply as a new applicant and all new applications require in person submissions.

1. Can I pay for my passport with cash?

No, passports can only be paid for using check, money order or cashier's check. *Passport Processing Fees ($35 per application) can be paid using in-state check, money order, cashier's check or credit cards.

Teenagers, ages 16-17, with their own identification can apply for a passport by themselves; however, it is recommended that at least one parent appears in person with the child to identify him/her and to show parental awareness.

If you need to request a copy of the document through the mail, please send a letter indicating the type of document and the book and page number of the document. The cost is one dollar ($1.00) per page. If you need a court certified copy, the cost is two dollars and fifty cents ($2.50) for the first page of the document and fifty cents ($0.50) for each additional page. 5. How do I obtain information on foreclosures?

The foreclosure properties that are sold in Fulton County are advertised in the legal notices sections of Fulton County Daily Report once a week for four (4) weeks prior to the sale of the property. Foreclosure properties are sold the first Tuesday of every month between the hours of 10:00 a.m. and 4:00 p.m. on the front steps of the Courthouse.

6. How do I register a business of DBA?

By visiting Superior Court Record room you verify if the trade name y is being used by another party in Fulton County. If the name is not in use, then you must submit a trade name application and a one hundred sixty-one dollars and fifty cent ($163.50) processing fee. You can obtain a copy of the trade name application by clicking on the link below.
